Terms and Conditions and Privacy Policy

These Terms and Conditions of Participation and Privacy Policy (hereinafter collectively referred to as the “Terms and Conditions”) apply to participation in our sweepstakes and contests that refer to them (hereinafter referred to as “Sweepstakes”).

The terms and conditions of participation include rules regarding, among other things, participation, information about the prizes, and the processing of participants’ data, as well as their rights to object and withdraw consent. The terms used are gender-neutral.

1. Reference to the contest announcement

Additional details regarding the eligibility requirements, required actions, the duration of the contest, individual phases of the contest, and any prizes may be provided in the descriptions made available to participants as part of the contest. These detailed descriptions take precedence over the terms and conditions of participation.

2. Age Restriction

You must be at least 18 years of age to participate.

3. Geographic Restriction

To participate, you must have your place of residence, registered office, or habitual residence in the region(s) listed below:

Germany, Austria, and Switzerland.

4. Additional Eligibility Criteria

The following eligibility requirements and restrictions apply to our sweepstakes:

Exclusion of Employees and Other Parties: Excluded from participation are our employees and the employees of our sponsors who are or were involved in the creation or administration of this contest, as well as their spouses or domestic partners, parents, children, siblings, or persons living in the same household, provided that these individuals were aware of—or should have been aware of—the employees’ aforementioned involvement with the contest.

Become a Fan or Follower: Participation in the contest is open only to those participants who become fans, followers, or subscribers of the social media accounts listed in the contest announcement or of the social media accounts on which the contest is being held.

5. Information on Profits

Below, we provide participants with details about the prizes we are giving away and the terms and conditions associated with them.

Selection of Winners: Winners will be selected at random.

6. Additional Information on Prizes

Please note the following additional information regarding the prizes:

Prohibition on Transferring and Paying Out Prizes: The right to a prize is nontransferable. Prizes cannot be paid out in cash or exchanged for anything else.

7. Contests on Online Platforms

If the contest takes place on an online platform or social network (hereinafter referred to as “online platform”), the following provisions also apply.

Participants may not assert any claims against the online platform arising in connection with their participation in the contest or their use of the platform. Participants acknowledge that the contest is in no way sponsored, endorsed, or organized by the online platform, nor is it affiliated with the online platform in any way. All information and data provided by participants or collected from them in connection with the contest will be made available only to us and not to the online platform. We ask that all inquiries and comments regarding the contest be directed to us and not to the online platform.

If we receive participants’ data from the online platform based on their consent or another legal basis, the use, storage, and other processing of this data will be limited to the purposes specified in connection with the sweepstakes (e.g., if we are able to pre-fill users’ email addresses on a sweepstakes entry form).

If participants are asked to enter login credentials, that information will be processed by the provider of the online platform. In particular, we do not have access to participants’ passwords.

In addition to these Terms and Conditions of Participation, the online platform’s applicable terms and conditions and privacy policy apply to the use of the platform. Further information regarding the consent process, details about consents granted, and options for revoking them can be found in the online platform’s privacy policy.

8. Information on Warranty and Liability

Please note that the contest and the prizes are voluntary offerings on our part, and are not subject to the same scope of warranty and liability as, for example, a purchase of the prizes awarded in the contest made independently of the contest.

Legal Remedies: Legal remedies are excluded with respect to the drawing of winners and any evaluation of the contest entries submitted.

9. Privacy Policy

We process personal data (hereinafter also referred to as “data”) of participants in sweepstakes and contests only in compliance with the applicable data protection regulations, to the extent that such processing is necessary for the organization, conducting, and administering the sweepstakes (Art. 6(1), sentence 1, subparagraph (b) of the GDPR), the participants have consented to the processing (Art. 6(1), first sentence, letter a) GDPR), or the processing serves our legitimate interests in the security of the sweepstakes or in the protection of our interests against misuse, in accordance with Art. 6(1), first sentence, letter f) GDPR.

Participants’ data will only be transferred to third parties if this is necessary for the conduct of the sweepstakes (e.g., for the sponsor(s) to send out prizes, or to technical service providers or agencies contracted in connection with the conduct of the sweepstakes) or if a participant has consented to such transfer.

As part of the sweepstakes, we inform participants which of their details are required for entry.

Participants’ data will be deleted as soon as the contest ends and the data is no longer needed to notify the winners or to address any questions regarding the contest. As a general rule, participants’ data will be deleted no later than 6 months after the end of the contest. Winners’ data may be retained for a longer period, for example, to answer questions about the prizes or to fulfill the prize obligations; in this case, the retention period depends on the type of prize and may be up to three years for goods or services, for example, to handle warranty claims. Furthermore, participants’ data may be stored for a longer period, for example, in connection with (data protection-compliant) reporting on the contest in online and offline media or in the case of contest entries published on social media.

If data was also collected for other purposes in connection with the sweepstakes, its processing and retention period are governed by the privacy notice applicable to that use (e.g., when subscribing to a newsletter as part of a sweepstakes).

In addition, whenever we process your data or provide additional information regarding the processing of your data, we include a link to our privacy policy and refer you to it.

As data subjects under the GDPR, participants are entitled to various rights, which arise in particular from Articles 15 through 21 of the GDPR and, in the case of Swiss law, from the Swiss Data Protection Act (DSG):

  • Right to Object: You have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data carried out pursuant to Article 6(1)(e) or (f) of the GDPR; this also applies to profiling based on these provisions. If your personal data is processed for the purpose of direct marketing, you have the right to object at any time to the processing of your personal data for such marketing purposes; this also applies to profiling to the extent that it is related to such direct marketing.
  • Right to Withdraw Consent: You have the right to withdraw your consent at any time.
  • Right of Access: You have the right to request confirmation as to whether the relevant data is being processed, as well as access to that data, additional information, and a copy of the data in accordance with legal requirements.
  • Right to Rectification: In accordance with legal requirements, you have the right to request that data concerning you be completed or that any inaccurate data concerning you be corrected.
  • Right to Erasure and Restriction of Processing: In accordance with legal requirements, you have the right to request that data concerning you be erased without delay or, alternatively, to request a restriction on the processing of such data in accordance with legal requirements.
  • Right to Data Portability: You have the right to receive the data concerning you that you have provided to us in a structured, commonly used, and machine-readable format, in accordance with legal requirements, or to request that it be transmitted to another data controller.
  • Complaint to a supervisory authority: You also have the right, in accordance with legal requirements, to file a complaint with a supervisory authority, in particular in the Member State of your habitual residence, your place of work, or the location of the alleged infringement, if you believe that the processing of your personal data violates the GDPR.
