Consumers have the following right of cancellation. A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity:
Right of cancellation
You have the right to cancel this contract within 14 days without stating any reasons.
The cancellation period will expire after 14 days from the day on which you or a third party other than the carrier and indicated by you acquires physical possession of the goods.
To exercise your right of cancellation, you must inform us (COMMIT GmbH, Poststraße 37a, 38704 Liebenburg, telephone: +49 5346 912 415, fax: +49 5346 912 416, e-mail: info@creatinghealth.de) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post, fax or e-mail).
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.
Consequences of cancellation
If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We can refuse the repayment until we have received the returned goods or until you have provided proof that you have sent the goods back to us, depending on which occurs earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day deadline.
You bear the immediate costs of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion or premature expiry of the right of cancellation
The right of cancellation shall expire prematurely in the case of contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
General information on returns
- Please avoid damaging or contaminating the goods. If possible, please return the goods to us in their original packaging with all accessories and packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against transport damage.
- Please do not return the goods to us carriage forward. We will be happy to reimburse you for the postage costs if requested, provided that you are not liable for them.
Please note that the above paragraphs 1-2 are not a prerequisite for the effective exercise of the right of cancellation.
